TERMS & CONDITIONS

GENERAL

1. I reserve the right to decline any commission orders without any explanation.2. Be honest and responsible customers, only participate in any transaction only if you are able to pay of your own ability (have your own Paypal account/credit card and do not use someone else's especially your parents' if they're not aware and have not consented). Chargebacks against me due to irresponsible buying will automatically result to a permanent blacklist.
3. If you are a minor, have a consenting adult fill the form and make the purchase. The payer will be held responsible if there are any chargebacks and refunds against me.
4. You must be 18 years old or older to commission me NSFW art. By commissioning me a NSFW piece you are consenting that you're 18 y.o or older.
5. You will only receive full-resolution digital file/s of the commission. No physical item will be shipped to your home address.

PAYMENTS

1. All payments are upfront. I will not start the commission if the money as not been paid.
2. I also accept payments in installments if the price is over 300 USD

REVISIONS

1.I will provide screenshots of WIPs throughout the process. You are limited to 3 edit sessions during sketching stage, and 1 chance for minor adjustments in the finishing stages (including hues, painting in missing details, etc.).
2. Any revisions after this point will have an additional +25% of the base price per revision.No major changes are allowed in the finishing stage that will affect the overall composition of the piece.
3. Changing reference is allowed only if i haven't started on your commission. Please ask first if i started or not.

DEADLINES AND DELIVERY

1. Unless the client states a deadline, the commission may take up to 1-2 months. On average, the illustration may be finished 1-3 weeks after receiving the request. If i feel like it might take longer time, I will make sure to inform you.

REFUNDS

1. Do not issue chargebacks. You may request a refund and cancel the commission only if i take more than 5 months without progress.
2. If the invoice was sent and hasn't been paid for over a week, i will cancel the commission unless there's a mutual agreement regarding the delay.
3. In case of dissatisfaction with the final result, refunds can not be given.

VTUBER USE

1. Every VTuber Model comes with a full commercial usage license included in the price.
2. The time for finishing art for a Live2D ready model can vary between 1-5months.
3. Responsibility to establish contact between me and the rigger is imposed on the customer.
4. Any additional changes, that do not affect the rigging process, after the sketch and planning process, will be charged extra.
5. Posting the model process of privately shared WIP’s is prohibited unless stated otherwise by me.
6. You are NOT allowed to share the model file with anyone at any time.
7. I am allowed to post your model as an advertisement and use it in my commission sheet.
8. You have to give visible credit to me on every social media or platform you are using the model on.
9. You are allowed to sell your model not higher than the price you paid for the model.
9. Please credit my twitter @ in your bio on twitter / twitch / YouTube as your VTuber parent!

RIGHTS, USAGE, & CREDIT

1. Do not use the artwork for commercial use unless discussed beforehand; extra charges or royalties will apply for commercial projects.
2. Any Work done or made available to the client must not be used for AI (Artificial Intelligence, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.
3. Please don't trace or edit the commission I give you in any way.Artist Rights
1. I retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, and displaying the Work in my websites, social media and portfolios according to my discretion. I have rights to repurpose unused process work for future projects, personal or otherwise.
2. The process will likely be posted i.e. on Twitter and/or streamed on Twitch or Youtube unless Clients request otherwise before the project begins. A NDA or confidential commission status may be subject to a privacy (i.e. +25%) fee.Client Rights
1. Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which must not be transferred to any other parties. Personal use includes: (ex: Social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, physical prints and products) that is not for sale or distribution to any other party.
2. Character designs are not allowed to be resold for high price.
3. Clients may not at any time modify, edit, change the Work without permission from the Artist.
4. If you post artwork on various platforms,credit must be given alongside a disclaimer that it is not your work;‘art by Dagmell’,‘art @/DagmellV’,‘🎨@/DagmellV’ is more than okay.Commercial Rights
1. Unless specified in the commission information or otherwise discussed and agreed upon, commercial licenses and reselling rights are not included. Commercial means usage on streams, broadcast content, or any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform.
1.1 Non-commercial use (does not have additional fees).
1.2 Usage on monetized platforms (Twitch, YouTube, etc.), credits required! 100% * 1,5.
1.3 Monetized platform usage (credits!), selling artwork as merchandise in low quantity, for small businesses only 100% * 2.Selling artwork as merchandise in larger quantity or big businesses 100% * 3.
